Terms of Service

1. The short version

You use 4thCoach to record sports clips and get AI-generated coaching feedback. We do our best to make the analysis useful, but it's a tool — not a substitute for a real coach, medical advice, or professional judgment. If you upload a clip, it's yours; we just need permission to process it so we can give you back the analysis. Use the service responsibly and don't try to break things.

2. The agreement

These Terms govern your use of 4thCoach, the iOS app and any related websites or services we operate. By using 4thCoach you agree to these Terms. If you don't agree, don't use 4thCoach.

3. Eligibility

4thCoach accounts are for adults only. You must be at least 18 years old to create a 4thCoach account. 4thCoach is designed for parents, guardians, and coaches to record and review video of the young athletes in their care — those athletes never create their own account or sign in; they're managed as profiles under the adult account holder, who is responsible for their use of the service.

4. Your account

You sign in with Apple, Google, or email and password. Keep your credentials safe — anything done from your account is your responsibility. Tell us promptly at bryan@4thcoach.com if you suspect your account is compromised.

5. Your content

You own the clips, captions, and other content you upload to 4thCoach ("Your Content"). By uploading, you grant us a worldwide, royalty-free license to host, process, transmit, analyze, and display Your Content solely as needed to operate 4thCoach for you. This license ends when you delete the content or your account, except for backups that age out on a normal rotation.

You're responsible for Your Content. Don't upload anything you don't have the right to share, anything that violates another person's privacy, or anything illegal.

Other people in your clips. If Your Content includes anyone other than yourself — a teammate, opponent, coach, family member, anyone walking through the background — you confirm that you have their permission to film them and to upload that footage to 4thCoach for analysis. If the person is a minor in your custody, you confirm you have the right as their parent or guardian to consent on their behalf. You agree to indemnify and hold 4thCoach harmless from any claims by third parties whose likeness or voice appears in Your Content without their consent.

What gets sent to Google. Your clips are sent to Google's Gemini API to generate the coaching analysis. Google's processing terms apply to that leg of the trip; Google does not use your clips to train its public models. See our Privacy Policy for the full data flow.

6. How analysis works (and its limits)

4thCoach uses third-party AI models (currently Google's Gemini to generate coaching feedback, with Anthropic's Claude double-checking the written findings). The output is best-effort and can be wrong, incomplete, or inconsistent. Don't use it for anything safety-critical or as a substitute for professional advice.

We may change the model, the analysis prompt, or the features we offer at any time as 4thCoach evolves.

7. Acceptable use

You agree not to:

• Use 4thCoach to break the law, violate someone's rights, or cause harm.
• Upload clips depicting minors without the consent of a parent or guardian.
• Reverse-engineer, decompile, scrape, or otherwise abuse the service.
• Try to access another user's account or data.
• Use 4thCoach to generate or distribute content intended to harass, defame, or threaten anyone.
• Bypass any technical limits we set (rate limits, storage caps, auth checks).

We have zero tolerance for objectionable content or abusive behavior. We may suspend or terminate accounts that post or submit such content, or that otherwise violate these rules.

8. Beta software

During the beta period, 4thCoach is provided as-is. Features may change, break, or disappear. We may collect more diagnostic data during beta to help us debug. We don't promise uptime, data retention, or backward compatibility while the beta runs.

9. Pricing, subscriptions, and payment

4thCoach has a free tier and an optional paid subscription, 4thCoach+. 4thCoach+ is an auto-renewing subscription billed monthly or annually; the exact price is shown before you subscribe and may vary by region and over time.

• Apple App Store (in-app purchase).Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple Account settings (Settings → your name → Subscriptions). Refunds for App Store purchases are handled by Apple.
• Web checkout (Stripe). The subscription renews automatically at the end of each billing period until you cancel. Update your payment method, switch plans, or cancel anytime from the Account screen in the app or the billing portal. When you cancel, you keep 4thCoach+ through the end of the period you already paid for.

Canceling stops future charges; it doesn't refund the current period unless the law where you live requires it. If a subscription lapses, you keep your account and your data — the free tier's limits simply apply again. We'll give clear notice before any price change takes effect at your next renewal.

10. Termination

You can delete your account at any time from inside the app. We can suspend or terminate accounts that abuse the service, violate these Terms, or pose a security risk. When your account is terminated or deleted, your clips, analyses, and player profiles are removed per our Privacy Policy.

11. Disclaimers

4thCoach is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We don't guarantee that the analysis is correct, complete, or suitable for any particular use.

12. Limitation of liability

To the maximum extent permitted by law, 4thCoach and its operators are not liable for any indirect, incidental, consequential, special, or exemplary damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim related to 4thCoach will not exceed the greater of (a) the amount you have paid us in the 12 months before the claim arose, or (b) US $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless 4thCoach and its operators from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the service.

14. Changes to the Terms

We may update these Terms when the service changes. The "Effective" date at the top reflects the most recent change. If a change materially affects your rights, we will notify you inside the app or by email before it takes effect.

15. Governing law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in Wayne County, Michigan, and you consent to that venue.
